1972-056A OrdinanceORDINANCE NO. 1972-56A Offered by Councilman Bartelstone PROVIDING FOR ESTABLISHMENT OF FIRE LANES IN B-1 and B-2 ZONING DISTRICTS AND SETTING PENALTIES FOR VIOLATION OF SAME. BE IT ENACTED BY THE COUNCIL OF THE CITY OF FAIRLAWN: Section 1: To guard against the occurrence of fires and to protect the property and lives of the citizens of the City against damages and accidents resulting therefrom, the regulations set out in Section 2 hereof are established. Section 2: Subsection 2-A. Wherever on public or private premises in a B-1 or B-2 Zone as defined and established by the Zoning Code of this City, the Director of Public Safety on advice of the Chief of the Fire Department shall find that parking of vehicles does or will interfere with ready access by the Fire Department to a structure on the premises for the purpose of fighting fires therein, or with ready access to s fire hydrant installed for protection of the premises, the said Director shall designate a reasonable area or areas leading to and adjacent to said structures and hydrants a s fire lane s. Subsection 2-B. Upon the designation of ~ fire lane as provided in Subsection 2-A of this ordinance, the Director of Public Safety shall notify, in ~riting, the o~ner of the premises of said designation and of the extent of such lane. Not later than ninety days after receipt of such notice, the o~ner shall cause to be placed or erected signs and markers along said fire lane notifying all persons of the existence of the fire lane. There- after the o~ner shall maintain said signs and markers in legible condition. The design and location of said signs and markers shall be specified by the Director of Public Safety and shall not be less than those required for such signs and markers on public highways as prescribed by the Ohio Department of Highways. Section 3: Subsection 3-A. No person shall park a vehicle in any fire lane designated as such pursuant to this ordinance, nor within l0 feet of any fire hydrant. Subsection ~-B. No owner of premises whereon a fire lane has been designated pursuant to Subsection 2-A of this ordinance, who has been given notice pursuant to the provisions of Subsection 2-B, shall fail to provide, erect, install and maintain the signs and markers as required. After 90 days after receipt of notice and specifications as provided, each day' s failure to comply with the provisions of Subsection 2-B shall be deemed s separate offense. Section 4: Whoever shall violate the provisions of Subsections 3-A or 3'-B of this ordinance shall be guilty of s misdemeanor and shall be fined not more than Fifty Dollars ($50.00); provided, however, that no person shall be deemed guilty of violation Subsection 3-A unless at the time of the alleged violation there were conspicuously posted the signs and markers provided for in Subsection 2-B. Section 5: Ordinances 1970-84 and 1971-96 are hereby repealed. Section 6: This ordinance shall be in full force and effect from and after 30 days after its enactment. Passed March 20, 1972 William F. Fsirlawn, Ohio 44313 Sir: In accordance with City of Fairlswn Ordinance 1972-56A, s survey was made of all B-1 and B-2 Zones in the City of Fairlswn this date. It is the desire of the undersigned that this report be considered as in compliance with the aforementioned Ordinance, Section 2, Subsections 2-A and 2-B. The following places of business on West Market Street, and other areas in the City, are deemed to provide adequate access to fire fighting equipment as of this date. A further study of these areas will be conducted in the future when the need arises. At that time, some redes- ignation of certain ~re~s may be made. Those areas now providing ready access are: The Executive Building at 3200 W. Market Street The Hilton Inn West st 3180 W. Market Street The Holiday Inn at 3150 W. Market Street The Seibert-Keck Building at 2950 W. Market Street The Wyant Building at 2858 W. Market Street The Plaza Building at 2855 W. Market Street The Village Square Complex st 55 Shiawassee Avenue The Village Theatre Office Bldg. st 77 N. Miller Road The Office Building st 30-34 Merz Blvd. (which also incorporate parking facilities for those offices located in the basement of the Lawson Building with an address of 28 Metz Blvd.) The 25 Ghent Road Complex (Michaels Building) at 25 Ghent Road, which extends parallel with the first block of Crswfis East of Ghent Road Page 2- Mayor Joseph A. Hartlaub June 15, 1972 As a result of the study of Fairlawn Plaza, the following recommendations are herewith submitted: The entire edge of the sidewalk of the Plaza Building be painted yellow on the full vertical edge with an adjacent four inch yellow strip on the top edge of the sidewalk. The old signs reading "Fire La~e, Don't Park this Side" be removed and placed every twenty-five feet apart on the building wall on the east side of the Plaza Building from front to rear. These signs to be placed st the same intervals on the fence on the opposite side of this east driveway extending as f~r b~ck ~long the drive as those on the building. These signs to be at a heighth of at least six (6) feet from ground level to the bottom of the sign. This East driveway to be designated ss a Fire Lane with no parking allowed. On the front of the Plaza Building it is recommended that signs be placed on each support pole at ~ distance not less than every 100 feet. These signs to be double faced and black lettering on a white background. They should be at least 18" X 24" and should read, "Parcel Pickup Zone, 15 Minute Parking Only". These signs to be placed st least 6' from the top of the side- walk to the bottom of the sign. As a result of the study of the Summit Mall, the following recommendations are herewith submitted: An area extending 25 feet from the edge of the curb of the side- walk abutting the Mall Building to be designated as a Fire Lane. Ail service areas of the Mall to be designated as Fire Lanes. Signs to be placed around the entire circumference of the Mai1 Building at a maximum of 100 Feet apart with the wording "No Parking, Fire Lane". Any signs designating "No Parking in Cruising Lanes" to be utilized at the out edge of the Fire Lanes. Signs to be erected on the walls surrounding each service area to supplement those signs prohibiting parking (Tow-Away Zone). The additional signs to warn that this area is now a "Fire Lane". The entire curbing surrounding the Mai1 Building to be painted yellow. The curbs in the Service Areas to be painted yellow also. It is my opinion these recommendations will suffice to provide for the safety of the people and merchants in the City of Fairlawn. As herein be- fore stated this entire program can be reviewed at any time in the future and new areas designated for restricted parking where the situation may warrant.
