1971-024 ResolutionRESOLUTION NO. 1971-2~ OFFERED BY: COUNCILWOMAN ZIMME~ AUTHORIZING AND APPROVING THE CONSTRUCTION OFAN ICE SKATING FACILITY ON A PARCEL OF LAND LOCATED AT THE INTERSECTION OF NORTH MILLER ROAD AND SAND RUN PARKWAY, ASSUMING THE LIABILITY FOR SAID OPERATION AND RE- LEASING W. R. CRONIN FROM ANY CLAIM MADE FOR SUCH OPERATION, AND EXPRESSING THE APPRECIATION TO MR. CRONIN FOR HIS GENEROUS USE OF THE LAND. WHEREAS, ~he Recreation Committee of Fai~lawn Village has ~eques~ed permission of this Council ~o eonst~ue~ an ice skating ~ink on ee~ain p~ope.~y located a~ ~he southeast intersection of Noz'th Miller. Road and Sand Run Pa~kway~ and WHEREAS~ W. R. Cmonin, the owne~, has gPaciously g.~anted permission fo~ the use of said land fo~ ~he purpose as he~e- mnbefo~e stated. BE IT RESOLVED by the Council of the Village of Faim- lawn~ Summit County~ Ohio' Section 1. That i~ is hereby determined tm. be necessary to.. the health and the general welfare of the Village Fairlawn and its inhabitants, and particularly to its youths, to cons~nuct and to make available an ice skating rink on a parcel of land located Southeast of the intersection of North Miller Road and Sand Run Parkway. Section 2. Section S. That the Recreation Committee is hePeby directed to construct an ice skating rink on the said p~o- perry fo~ the use of the inhabitants of Fairlawn Village and that fo~ such construction they shall make use of funds available to said committee by reason of the appropriat:on 0~dinance No. 1970- but that all statements thereby shall be forwarded to Council for approval before payment. That this Council does hereby assume and accept any and all liability fo~ any claims fo~ injury or damage occasioned by the use of said p~ope~ty as a skating rink and does hereby relieve and ab- solve H~. W. R. C~onin from the same. Section That this Council does hereby express its appre- ciation to the said W. R. Cronin for his generous offer of said property for the purposes intended to the Village and for the benefit of the inhabi- tants of the Village of Fairlawn. Section 5. That this Resolution is hereby declared to be an emergency measure to the health, safety and gener, al welfame of the Village and its inhabitants, pmo- viding healthy, beneficial ~ec~eation to the ~esi- dents and inhabitants of the Village, and by Peasen thoz'eof shall be in full foz. oe and effoct f~om and after the earliest period allowed by law.
