1976-119 ResolutionRHSOLUTION 1976-119 Offered By Mayor Hartlaub AUTHORIZING THE EXECUTION AND FILING OF AN APPLICATION FOR A FEDERAL GRANT TO ASSIST IN FINANCING THE CONSTRUCTION OF A FIRE STATION ON S. SMITH ROAD, AND DECLARING AN t'~2R:_AS, Title I of the Local Public Works F~nployment Act of 1976 (Pub. L. 94-369) provides for the making of grants by the Secretary of Commerce to states and local public bodies to assist them in the construction, renovation, and repair of local public works projects; and, '.',~?EREAS, The City of Fairlawn desires to construct a fire station on S. Smith Road; and, I~HEREAS, it is recognized that the contract for the Federal grant will impose certain obligations and responsibilities upon the City and will require among othe~ things (1) assurances that such p~ojects will not have serious detrimental environmental effects, (2) compliance with Federal labor standards, and (3) compliance with Federal requirements relating to equal employment opportunity; and, W~ER£AS, The City of Fat:lawn is duly authorized under and pursuant to the Constitution and laws of the State of Ohio to ca~ry out said project and execute such grant as shall be received. ' NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Fairlatvn, Ohio: Section 1: That an application be made to the Economic Development Administration of the Untted.,State~ Department of Comme~ce fo~ a grant authorized by Title I of the L~cal Public Wo~k~ Employment Act of 1976. Section 2: The ~:ayor is hereby authorized to execute and to file such application with the Economic Development Administration o~ the United States Department of Commerce, to execute such contracts as are required .by the said Department, and to act am the authorized correspondent of the Applicant', Section 3: That the proposed work for which the grant is applied, is in accordance with the published regulation for the said Local Public ~',~'orks Act, and that, should said grant be made, the Applicant will carry out said project designated in the application and approved by the United States Department of Commerce. Section 4: That this resolution is hereby declared an emergency measure for the reason that said application s~ould be £iled promptly in order that the necessary pubItc improvements will be available at the earliest possible moment, and it shall take e££ect and he in ~orce immediately upon its passage and apprgval by the otherwise, it shall take e~£ect and he in force at ~the e~lie~tme allowed by law.
