AUTHORIZING THE EXECUTION AND FILING OF AN APPLICATION FOR A F~D£RAL GRANT TO ASSIST
IN FINANCING TH~ CONSTRUCTION OF A STORM S~%.¥ER OFF BANCROFT ROAD~ AND D.=-CLARING AN
F_3,~ ERG ENCY
I'~EREAS, Title I of the Local Public V:orks Employment Act of 1976 (Pub. L. 94-369)
provides for the making of grants by the Secretary of Commerce to states and local public
bodies %o assist them in the constructton~ renovation, and repair of local public works
projects; and~
%'~q£REAS, The City of Fairlawn desires to construct a storm sewer off Bancroft
Road approximately 224 feet to Schocalog Run; and,
t'~'~_--RE~S, it is recognized that %he contract for the federal grant will impose
certain obligations and responsibilities upon the City and wtll require among other
th~ngs (1) assurances that such projects will not have serious detrimental environmental
effects, (2) compliance t~th Federal labor standards, and (3) compliance w~th Federal
requirements relating.to equal employment opportunity; and,
I%'HEREAS~ The City of Fairlawn is duly authorized under and pursuant to the
Constitution and laws of the State. of Ohio %o carry out said project and execute such
grant as shall be received.
NOW, TH£REFORE, BE IT RESOLVED By the Council of the City of Fatrlawn, Ohto~
Section 1~ That an application be made to the Economic Development Administration
of the United"States Depar'tment of Commerce for a grant authorized by Title T of the
Local Public Works F~ployment Act of 1976.
Section 2: The ~tayor is hereby authorized to execute and to file such application
with the Economic Development Administration of the United States Department of
Commerce, to execute such contracts as are required 'by the said Department, and to
act as the authorized correspondent of the .Applicant;-
Section 3: That the proposed work for which the grant is applied, is in accordance
with the pubIished regulation for the said LocaI Public Works Act, and that, should
$~td grant be made, the Applicant will carry out said project designated in the
application and approved by the United States Department of Commerce.
Section 4: That this resolution is hereby declared an emergency measure for the
reason that said application should be filed promptly in order that the necessary
public improvements will be available at the earliest possible moment, and it shall
take effect and be in force immediately upon its passage and approval by the Mayor~
