1976-115 OrdinanceORDINANCE ~976 - ~5 Offered by Mayor Hartlaub AUTHORIZING AND APPROVING A CONTRACT WITH SIGNAL SERVICE COMPANY OF WARRENSVILLE HEIGHTS, OHIO: SETTING CONDITIONS AND SERVICES, DETERMINING COMPENSATION: DECLARING AN EMERGENCY. BE IT ENACTED BY THE COUNCIL OF THE CITY OF FAIRLAWN, OHIO- Section 1- A contract between the City and the Signal Service Company of %'arrensville Heights, for the maintenance of traffic signals ~ithin the City for the year beginning October 1, 1976, is hereby authorized and approved. Secti on 2- (b) (o) (e) Said contract shall provide for- Relamping all signals ~.ithin the city and replacing any burned out lamp for.a period of 12 months, for a total price of ~1,055.$0. Replacing any visor or lens found defective, for the-cost of materials supplied. Performing such other service and maintenance as may be · required, including emergency service for any purpose, for an hourly charge of $17.00 portal to portal basis. All service to be provided upon receipt by the Company of a work order issued by the City Streets Commissioner, Safety Director or Chief of Po]ice. Continuation of the contract on a year-to-year basis; provided, hox~'eYer, that ~0 days prior to the expiration of the current contract herein authorized~ negotiations may be had between the parties on the subjects of service and compensation; and provided further that upon expiration of one year~ either party may. cancel by.. ~i¥ing the other thirty~ days notice in ~-riiing of its intent to do so. ~ Section ~' That it is hereby found and determined that this legislation complies ~'ith Section 191_ .__99, O.R.C. regardin~ notification of mee'tin~rs~. and ail deliberations of this Cot~ncil pertaining hereto have been con- d~ct. ed in accordance there~-il.h. Section ~- This Ordinance is hereby declared to be an emergency measure necessary to the public peace, health and safety for the reason that continued maintenance of signal facilities is at all times required to permit.sa£e movement of vehicles in the City streets, and it shall therefore be in full force and effect from and after its enactment and approval by the 5iayor.
