1976-086 OrdinanceORDINANCE 1976- 86 Offered by Mayor Har%laub ESTABLISHING POSITION OF PART-TIME DOG WARDEN, SETTING COMPENSATION, AND APPROPRIATING ~1,500. O0 THEREFOR. WHEREAS, there have been many complaints by residents'concerning dogs and other animals running loose in violation of state law and municipal ordinances, and WHEREAS, the complaints have been in greater volume during the summer months, and WHEREAS, such complaints are presently handled by the Summit County Dog Warden and it is deemed necessary to supplement the service rendered by providing a periodic patrol service. NOW THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE CITY OF FAIRLAWN, 0HIO; Section l- There is hereby created the position of Part-Time Dog Warden. Section 2' The duties of the-position created in Section I shall be to police the City of Fairlawn for animals running at large and to enforce existing state law and municipal ordinances pertaining thereto. Section 5' The Part-Time Dog Warden shall be under the supervision of the Director of Public Safety. Section ~' The period of employment shall be from May 1 to October of each year and for a maximum of thirty' (50) hours per week. Section 5' The position herein created is determined to be a part- time position for the purpose of retirement and/or other fringe benefits. Section 6' The DirectOr of Public Safety may utilize more than one person for the position herein created, provided that the hours, pay schedule and other limitations set forth herein are complied with. Section 7' Compensation for the position of Part-Time Dog Warden shall not exceed the rate of ~2.50 per hour or $75.00 per week. Section 8' .The Director of Public Safety shall appoint-the person or persons to the position created hereby. Section 9' There is hereby appropriated the sum of $1,500.00 from the General Fund of the City of Fairlawn to pay the compensation hereunder. Section 10- The Finance Director is hereby authorized and directed to make the appropriate entries and issue vouchers and warrants in the usual form pursuant hereto. Section 11- That it is hereby found and determined that this legisla- tion complies with Section 121.22, O.R.C. regarding notification of meetings and all deliberations of this Council pertaining hereto have been conducted in accordance therewith. Section 12- That this ordinance is declared to be an emergency measure necessary to the health, safety and welfare of the residents of the City of Fairlawn for the reason that many animals have been running loose, menacing residents, upsetting garbage cans and doing other damage and it shall therefore be in full force and effect from and after its enactment and approval by the Mayor or at the earliest time allowed by law.
