1976-021 OrdinanceORDINANCE NO. 1976-21 (Revised 3/11/76) Offered by Councilwoman McKinney AN ORDINANCE TO CONSENT TO IMPROVEMSq~T OF SMITH ROAD AND SPECIFYING COSTS TO BE PAID BY FAIRLAWN. WHEREAS, the Council did pass an Ordinance of Consent to improve Smith Road (County Highway 116) from Medina Road to Sand Run Road (C.H. 85), on July 6, 1971, and WHEREAS, the cost to Fairlawn was limited to the cost of adjusting Village-owned utilities, and WHEREAS, Summit County and the State of Ohio have gone to great expense to prepare plans in reliance upon the consent of Fairlawn, and WHERF2%S, State and/or Federal standards for highways carrying the 1971 traffic burden evidenced on Smith Road required and still require that the road surface be expanded to four lanes in order to obtain State,and/or Federal funding, and WHEREAS, the iCouncil did pass an Ordinance repealing the prior consent ordinance on September 15, 1975, and WHEREAS, at the time said repealing ordinance was passed there appeared to be a possibility that Smith Road could be improved from its unsafe conditions without widening, and WHEREAS, it is now apparent that said improvements cannot be funded without widening, and WHEREAS, the Director of Highways is considering improving a portion of the public highway which is described as follows: C.H. 116 Smith Road, from Medina Road to Sand Run Road (C.H. 85) widen to four lanes and resurface. Install curb and gutter. Improve grade and horizontal alignment, salvage existing pavement surface where possible, and WHEREAS, the Summit County Commissioners by resolution dated January 14, 1975, have agreed to maintain the road, and the road right of way at County expense, to keep the road open, and to pay for and install all required traffic control devices upon completion of said improvements. NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE CITY OF FAIRLAWN, OHIO: Section 1: That it is declared to be in the public interest that the consent of the City of Fairlawn be and such consent is hereby given to the Director of Highways to construct the above described improvement, in accordance with plans, specifications, and estimates as approved by the Director. Section 2: That Ordinance 1975-91 is hereby repealed in its entirety. Section 3: That it is hereby found and determined that this legislation complies with Section 121.22, O.R.C. regarding notification of meetings and all deliberations of this Council pertaining hereto have been conducted in accordance therewith.
