TO ESTABLISH AND ADOPT RULES, REGULATIONS
AND PROCEDURES FOR THE COUNCIL OF THE
CITY OF FAIRLAWN, OHIO.
BE IT RESOLVED by the Council of the City of Fairlawn that the
following rules and regulations shall govern its procedures
from and after their adoption.
Section 1: Any other ordinances or resolutions relating'to
rules, regulations and procedures of Council are
hereby repealed and shall be superceded by the
present resolution.
Section 2: Orqanization of Council
(a) A temporary chairman shall be elected by a
majority vote of Council at the first regular
meeting of each calendar year, to preside
until the President of Council is elected.
(b) The President and Vice-President of Council
shall be elected for terms of one year, at
the first regular meeting of Council. The
President of Council shall not be elected to
more than three successive terms of office as
President.
(c) Establish committees and select committee
chairman and members who shall serve for
terms of one year, at the first regular meet-
ing of Council.
(d) The President of Council shall appoint a par-
liamentarian for questions of order and procedure.
Robert's Rules of Order shall govern insofar as
they are not in conflict with this resolution.
(e) Council shall hold a regular meeting on the first
Monday in each month and on the third Monday in
each month excepting July and August. When a
regularly scheduled meeting of Council falls on
a legal holiday, such meeting shall be held on
the next succeeding Monday. Regular meetings
shall be held in Council Chambers and shall begin
promptly at 7:30 P.M. on the days specified herein.
Special meetin% of the Council shall be c?~!~-/ as
provided in Seccion 4.13 of the Charter.
(f) The Mayor, the Law Director, and Municipal Engineer
and the Chief of Police shall attend regular meet-
ings of the Council. Any other administrative
officer or employee shall attend any meeting of
the Council or of any Committee of the Council at
which his presence has been requested by a member
of the Council.

Section 3: Procedures of Council
(a) At all regular meetings, the business of Council
shall be conducted in the following order:
1. Call to Order
2. Pledge of Allegiance to the Flag
3. Roll Call
4. Approval of minutes of last Council meeting
5. Reading of petitions, claims and communications
6. Reports of City Officials and Boards
7. Introduction of New Ordinances and Resolutions -
(to be referred to committees)
8. Public Hearings
9. Council Committee reports on new or pending
legislation
10. Other Business
11. Adjournment
(b) The Director of Law shall prepare all ordinances and
resolutions to be considered by Council and submit
the same to Council members no later than the F~iday
preceding the next scheduled meeting of Council.
The Director of Law shall also prepare the Agenda
for each scheduled meeting of Council, which shall
be distributed to the Councilmen and the Mayor, on
the Friday preceding the next council meeting. All
material for legislation shall be in the hands of
the Director of Law by the close of business .the
Wednesday preceding a scheduled meeting of Council.
(c) Council shall require full and complete minutes to
be kept of its proceedings, and the Clerk of Council
shall distribute the same to Councilman, Mayor,
Department Heads and Boards and Commissions, at
least three days before the next scheduled meeting
of Council.
(d) Council shall not approve any ordinance or resolution
unless such ordinance or resolution has been referred
to a Council Committee and considered by said Committee
(e) The President of Council shall have the option, at
Council meetings, to declare a recess for immediate
Council Committee consideration of new or pending
legislation. The Committee may report out measures
for consideration by Council at this meeting or may
retain such measure for further study. All measures
held in committee will automatically be reported out

(f) Voting by Council shall be by random roll call.
(g) Tabling motions shall be automatically., removed from
the table within 60 days, for voting or other action
by Counc i 1.

(h) Suspending the rules to enact legislation shall not
supercede legal requirements that such measures
enacted under suspended rules become effective
30 days after signing by the Mayor or approval
by Council over the Mayor's veto. Upon suspension
of rules, Council may require only one complete
reading and two successive readings by title only,
for immediate consideration of a new ordinance. A
motion to suspend the rule shall prevail upon five
affirmative votes of Councilmen.
(i) Reconsideration: A motion to reconside~ shall take
precedence over all other questions. Only a member
who was absent and excused or who votes with a pre-
vailing side may move for reconsideration of a Council
action and provided that the motion to reconsider be
made not later than the next regular meeting after
such action was taken. No motion to reconsider shall
be made more than once on any one matter and the same
number of votes shall be required to consider any
action of Council that will require to pass or adopt
the same.
(j) A ruling of the President of Council may be appealed
by any member, if duly seconded. A vote shall be'
taken on such motion and if approved shall be deba'~ed
and then put forth for voting to sustain or change
the ruling. A majority vote shall prevail.
(k) No member shall be allowed to speak lenger than five
minutes at one time, on any question without per-
mission of the President.. The President of Council
shall require similar limitation on non-members of
Council in attendance and requesting to be heard.
The President of Council shall maintain proper
Chamber decorum at all times.
(1) The determination that any part of this resolution
is invalid shall not invalidate or impair the force
or effect of any other part hereof except to the
extent that such other part is wholly dependent upon
the part declared invalid.
Section 4: Use of Council Chamber
The Council Chamber shall be used for meetings of Council,
or its Committees thereof. In the event the Council
Chamber is not being used by Council, or its Committees,
the Clerk of Council may grant special permits for the
'~e of the Council Chamber-, not in conflict wit~. the
specific uses intended.
Section 5: That this resolution is hereby declared to be an emergency
measure necessary to the health, safety and general welfare
of the city by reason of providing an orderly procedure to
the accomplishment of the work and functions of the Council
and by reason thereof, shall be in full force and effect
from and after its adoption.
