APPROPRIATING $6,000.00 FROM THE CAPITAL IMPROVEMENTS FUND
FOR CLEAN UP OF A PORTION OF SCHOCALOG CREEK, AUTHORIZING
THE MAYOR TO CAUSE DEBRIS TO BE REMOVED, AND DECLARING AN
EMERGENCY.
WHEREAS, Schocalog Creek was dredged by the Summit County Engineers in 1976,
and
WHEREAS, it is the responsibility of the Summit County Engineers to clean the
creek periodically, and
WHEREAS, there is an easement that belongs to the Summit County Engineers for
access , and
WHEREAS, it has come to the attention of the City that a great deal of debris
and dead trees have toppled into the creek in the last 5 years, and
WHEREAS, Summit County cannot clean up creeks until at least 1981 or thereafter,
and '
WHEREAS, the City wants to take remedial action to remove the debris, and
WHEREAS, if this project had been anticipated during the last calendar year,
provisions could have been made in the budget, and
WHEREAS, it is deemed expedient to take action this summer when the creek will
be at its dryest;
NOW THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE CITY OF FAIRLAWN, OHIO'
Section 1' There is hereby appropriated the sum of Six Thousand and no/100 dollars
($6,000.00) from the Capital Improvements Fund £or the purpose of cleaning the
portion of Schocalog Creek ~here it flo~s through Griffiths Park or thereabouts.
Section 2' The Mayor 'is hereby authorized to hire on a Work Order basis, local
labor and equipment on a day-to-day basis, as needed, to clean out the debris from
that portion of Schocalog Creek as specified in Section 1 above.
Section 3' The Finance Director is hereby authorized and directed to make appropriate
entries and issue the usual vouchers/~arrants pursuant hereto.
Section 4' That it is hereby found and determined that this legislation complies
with Section 121.22, O.R.C. regarding notification of meetings and all deliberations
of this Council pertaining hereto have been conducted in accordance therewith.
SectiOn $' This ordinance is declared to be an emergency measure necessary to the
health, safety, and ~elfare of the residents of Fairlawn for the reason that it is
imperative that this ~ork be accomplished ~hen the ~ater is at its lo-est level,
and therefore it shall be in full force and effect from and after its enactment and
approval by the Mayor or at the earliest period allo~ed by law.
