1979-025 OrdinanceORDINANCE 1979 - 25 Offered by Councilman Murphy AMENDING CHAPTER 278, C.O.F., BY ADDING SECTION 278.11 AND DECLARING AN EMERGENCY. WHEREAS, the Fairlawn Civil Service Commission has been duly qualified and appointed and is now in operation, and WHEREAS, the City desires to permit the Commission to operate in an autonomous manner without political considerations, and WHEREAS, this Council desires to establish a procedure for the funding of the general administration of the Commission; NOW THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE CITY OF FAIRLAWN, OHIO' Section 1' Chapter 278, C.O.F., is hereby amended by adding Section 278.11 which shall read as follows' "278.11 FUNDING FOR GENERAL ADMINISTRATIVE EXPENSE. (a) The Commission shall submit a preliminary budget for the .. following calendar year to the Finance Committee of Council no later than June 1 of each year for anticipated administrative expenses. (b) Council shall include in the preliminary budget approved in July and the operating appropriation approved in January an amount for,~_,the administrative operation of the Commission. /~ (c) The Finance Director shall cause to be issued the usual vouchers/warrants upon authorization of the Commission provided there is a sufficient balance remaining appropriated in the General Account earmarked for the Commission. (d) Supplemental appropriation shall be submitted to Council for approval." Section 2' Chapter 278, C.O.F., is hereby ratified and affirmed as amended. Section 3' That it is hereby found and determined that this legislation complies with Section 121.22, O.R.C. regarding notification of meetings and all deliberations of this Council pertaining hereto have been conducted in accordance therewith. Section 4' This ordinance is declared to be an emergency measure necessary to the health, safety and general welfare of the residents of the City of Fairlawn for the reason that a properly functioning Civil Service Commission is required by law and it shall therefore be in full force and effect from and after its enactmeht and approval by the Mayor or at the earliest time allowed by law. , 1979 Enacted' Apr~ 1 ] 6 !
