1978-101 OrdinanceORDINANCE 1978 - lOl OFFERED BY COUNCILMAN MARKEL APPROVING THE PLAT OF ELIA ESTATES AND DECLARING AN EMERGENCY. Section l' That the Plat of Elia Estates as certified by Charles W. Shaver, Registered Surveyor and approved by the Fairlawn Planning Commission on 12-8-77 is hereby approved. Section 2' That the President and Clerk of Council shall withhold signing the within plat until such time as a performance and maintenance bond satisfactory to the City Engineer has 'been posted by the developer and until the Summit County Commissioners and Sanitary Engineer. and the Akron ~Zrector of Public Service, Utilities, Engineer and Manager of Public Utilities have signed the final Improve- ment Plan for the subdivision. Section 3' This Plat Approval is conditioned upon the promise of the developers that sidewalks will be installed pursuant to the Improvement Plan. Section 4' That it is hereby found and determined that this legislation complies with Section 121.22 O.R.C., regarding notification of meetings and all deliberations of this Council pertaining hereto have been conducted in accordance therewith. Section 5' This Ordinance is hereby declared to be an emergency measure necessary to the health, safety and welfare of the residents of the City for the reason that the approval of the'plat is required prior to construction of streets and it is in the b'est interests and for safety reasons that construction be commenced prior to the winter season and it shall therefore be in full force and effect from and after its enactment and approval by the Mayor, or at the earliest period allowed by law.
