1978-087 ResolutionRESOLUTION 1978 - 87 OFFERED BY Councilman Krause AUTHORIZING THE MAYOR TO ENTER INTO A CONTRACT EFFECTIVE JULY 1, 1978, FOR CONTINUATION OF CURRENT SOLID WASTE DISPOSAL SYSTEM. WHEREAS, the City has been using a patented trash compactor system since July 1, 1975, and WHEREAS, Hybud Equipment Corporation has agreed to continue to provide the service upon terms outlined in a letter dated April 17, 1978, NOW THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FAIRLAWN, OHIO: Section 1: That the Mayor is hereby authorized to enter into a contract with Hybud Equipment Corporation for the continuation of use of the patented solid waste disposal system through December 31, 1978. Section 2: The terms of the agreement shall provide for the following: A. Monthly charge of $500.00 B. Container removal service fee of $52.50 through December 31, 1978. Such fee subject to cost of living adjustment every six months thereafter with maximum increase of eight (8) per cent annum. C. Actual landfill fee per container (currently $33.00 per compacted container at the Akron Hardy Road landfill). Section 3: That it is hereby found and determined that this legislation complies with Section 121.22, O.R.C. regarding notification of meetings and all deliberations of this Council pertaining hereto have been conducted in accordance therewith. Section 4: This Resolution shall be in full force and effect from and after its adoption and approval by the Mayor. Adopted: July 17, 1978 William F. Smith Road Fairl awn, Ohio Dear Joe: This letter is in response to the subject matter discussed at our recent meeting with Fairlawn 6ouncil and yourself. Hybud Equipment Corporation, beginuing July 1, will provide the City of Fairlawn with the patent protected Solid Waste Disposal System that has been in operation since July l, 197~. The lease rental of the equipment will be figured at a monthly charg~ of $~O0.00. This charge includes regularly scheduled preventive maintenance, cleaning & lubrication and regular inspection of the equipment for possible malfunction and all necess~y maintenance and repair to keep the facility in proper operating condition. Container rubbish removal service is figured at $~2.~0 for each service, in addition to this, the landfill fee of $~B.O0 for each compacted container as charg~d by the City of Akron at its Hardy Road Land_fill. The container removal se~-~ice charge will be in effect through December S1, 1978. At which time, this fee shall be adjusted upwax~ or down~ to reflect the chsng~ in the cost of doing business as measttred by i~uctuation in the Consumer Price Index (CPI)"all items" published by the U.S.Department of Labor ~au of Labor Statistics, U.S. city averag~, and every six months thereafter the measure of chang~ shall be the net change in the index for the preceeding 6 month period. No increase in charg~ sh~_ll exceed 8~ per az~t~. The charges for the dumping fee shall i-luctuate u_~o or down, whichever the case may be, as determined by the fees charged by the City of Akron, Hardy Road Landfill or at its futture energy recycling plant. Hartlanb From time to time when the City of Fairlawn requests an open to~ container, the container service charge will be $52.50 plus the price of the dump fee, which is $2~.00 at present. The same fluctuation in prLce shall be in effect as indicated above. At the time of container service removal, Hybud will clean up all the debris that falls away from the container at the time 6f removal. Any costs of monitoring the use of the equipment, attendants, if necessary or clean up and removal of debris that occurs from improper use of the facility shall be taken c~re of by the City of Fairlawn.
